A jury began deliberations yesterday in a civil suit filed by two men who claim that NBA star Allen Iverson's security detail beat them up at a Northwest Washington nightclub.
In closing arguments, attorneys for Iverson said the $20 million lawsuit is about nothing but money, and attorneys for the plaintiffs said Iverson must be held accountable for the July 2005 brawl at the Eyebar club.
The jury must sort through conflicting accounts about the injuries to Marlin Godfrey and David A. Kittrell. The men say they were roughed up after the security detail ordered them out of the VIP section at Eyebar to make room for Iverson and his entourage. The melee began, they said, when they balked at moving. Police were at the scene, but no criminal charges were filed.
"It's dignity and respect, responsibility and accountability," said Greg Lattimer, the plaintiffs' attorney. "These men were forced to suffer a huge indecency. They were attacked by Mr. Iverson's group not for who they are or what they did, but because they didn't move fast enough so that Mr. Iverson and his group could have the space they wanted."
Iverson, 32, was not in court yesterday. The Denver Nuggets guard and former Georgetown Hoya testified for about an hour Monday at his only appearance in six days of proceedings. He denied having any role in the fight and said he doubted his security team did.
Iverson's attorneys said that testimony showed the person at the center of the brawl was Terrence Williams, an Iverson acquaintance. The defense said Williams did not work for Iverson, but Lattimer said he did. Williams was not named in the suit. Iverson is being sued with Jason Kane, one of his bodyguards, who is suspected of taking part in the fight.
"You sued the wrong man," said Billy Martin, an attorney for Iverson.
Godfrey has said he suffered a broken eardrum, broken blood vessels and temporary loss of hearing. Kittrell has said he received bruises along with emotional distress.
There were some dramatic moments during the closing arguments. Lattimer told jurors that Kane's testimony differed from statements he made during a deposition in the case a year ago.
This week, Kane testified that his mother was gravely ill at the time of the deposition and that he was not thinking clearly. Within days, Kane said, his mother died.
Lattimer repeatedly told jurors yesterday that they should doubt Kane's inconsistent testimony because "his momma was sick." Lattimer pointed out a series of what he said were contradictions, each time using the phrase about Kane's mother.
As Lattimer went on, Kane, who is 6 feet 3 inches tall and weighs 300 pounds, rocked in his chair. At one point, Martin reached over, tapped Kane's arm and urged him to calm down. Williams, who admitted on the stand that he beat up Godfrey in the brawl, stormed out of the courtroom.
When U.S. District Judge Ellen S. Huvelle ordered a 10-minute recess, she urged Martin to have Kane remain in his seat. Kane eventually got up, and in the hallway outside the courtroom, one of the marshals told him and Williams to "keep your show of emotions to yourself." When the arguments resumed, two armed marshals were in the courtroom.
Later, during his closing argument, Martin told the jury that Lattimer was trying to provoke Kane. "How much more disrespectful can any human being be than try to provoke a man by talking about his dead momma?" Martin asked.
